UK Prize competition terms and condition

1. The Promoter

   The promoter is: London Botanical Drinks Limited, 39-45 Bermondsey Street, London Se1 3XF

2. The prize draws

   1. There are two prize draws: 

      1. the Everleaf Drinks’ website purchase draw; and

      2. the Everleaf Drinks’ Instagram post draw.

   2. The winner will win a three-night board and breakfast holiday for two to a hotel in the Santa Babara Resort in the Azores.

   3. The winner in each draw will be chosen at random as set out below.

3. How to enter

   1. Both prize draws will run from 00:01 on 1 January 2021 (the "Opening Date") to midnight on 31 January 2021 (the "Closing Date") inclusive.

   2. Every purchase made via the Everleaf Drinks’ website between the Opening Date and the Closing Date will be given a number and that number will be entered into the Everleaf Drinks’ website purchase draw.  

   3. To enter the Everleaf Drinks’ Instagram post draw you must, between the Opening Date and the Closing Date:

      1. “like” the competition Instagram post on the Everleaf Drinks’ Instagram page;

      2. follow the @everleafdrinks Instagram page;

      3. follow the @santa_barbara_azores Instagram page; and

      4. comment and tag the friend you would like to take with you on the trip

      5. Only qualifying entries will be included in the Everleaf Drinks' Instargram post draw
         
         

   4. The winner of the Everleaf Drinks’ website purchase draw will be the person who made the purchase via the Everleaf Drinks’ website.  The winner of the Everleaf Drinks’ Instagram post draw will be the person who made the Instagram post.

   5. No purchase is necessary to enter the Everleaf Drinks’ Instagram post draw.

   6. The Promoter will not be responsible for any failure to complete the actions in clause 3.3 due to equipment, network or broadband failure or any technical malfunction of any kind.

   7. By entering into either draw, you are agreeing to be bound by these terms and conditions.

   9. The winner of each draw will be chosen at random by a random number generator 

4. Eligibility

   1. Both draws are only open to residents in the UK aged 18 years or over, and shall not be open to:

      1. employees of the Promoter or its holding or subsidiary companies;

      2. employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the draws or their administration; or

      3. members of the immediate families or households of (a) and (b) above.

   2. In entering either draw, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the relevant draw.

   3. The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of either prize draw.

5. The prizes

   1. There are two three-night breaks for two people to the Santa Barbara Resort in the Azores to be won.

   2. The prize is for two people to fly economy class to the Santa Barbara Resort in the Azores for three nights and to stay in a hotel selected by the Promoter.  The prize must be taken between 1 February 2021 and March 2022 (excluding between 1 June 2021 and 30 September 2021).  The prize will also include a free surf lesson for two at the Santa Barbara  Resort (subject to availability) breakfast for 3 days, and 20% off food and drink whilst at the hotel.  The prize does not include travel insurance, food and drink consumed outside the hotel, spending money, other hotel costs such as the cost of phone calls made from the hotel, and tax or personal expenses. Any other costs incurred in addition to those set out above, and that are incidental to the fulfilment of the prize, are the responsibility of the winner(s).

   3. The winners will be responsible for ensuring that they and any person travelling with them are available to travel and that they hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified and that they have had any necessary vaccinations. Dates once notified to the hotel and airline cannot be changed.

   4. The prizes are subject to any regulations or restrictions in the UK or abroad relating to Coronavirus.  The Promoter will not accept any responsibility for any liability for changes made to, or any cancellation of, the trip due to Coronavirus, including any last minute cancellation of flights, any ban on travel or any quarantine or other restrictions imposed on people entering or leaving the UK or the Azores at any time.  

   5. Prizes are subject to availability. There is no cash alternative for the prize.

   6. The prize is not negotiable or transferable.

6. Winners

   1. The decision of the Promoter will be final and no correspondence or discussion will be entered into in relation to the decision.

   2. The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided and, in relation to the Everleaf Drinks’ Instagram post draw, the Promoter will announce the winner on the Promoter’s Instagram page. 

   3. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of the prize winners on the Promoter’s Instagram page on the Announcement Date. 

   4. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter by email to hello@everleafdrinks.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request. 

7. Claiming the prize

   1. If you are the winner of the Everleaf Drinks’ website purchase draw prize, you will have seven days from the Announcement Date to claim the prize by responding to the email or telephone message from the Promoter. If you do not claim the prize within seven days of the Announcement Date, your claim will become invalid.

   2. The prize may not be claimed by a third party on your behalf.

   3. The Promoter will make all reasonable efforts to contact the winners. If the winners cannot be contacted or are not available or have not claimed their prizes within seven days of the Announcement Date, the Promoter reserves the right to offer the relevant prize to the next eligible entrant selected at random from the entries received before the Closing Date.

   4. The Promoter does not accept any responsibility if you are not able to take up the prize.

8. Limitation of liability

   Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

9. Ownership of competition entries and intellectual property rights

   1. By entering the Everleaf Drinks’ Instagram post draw, you agree to:

      1. assign to the Promoter all your intellectual property rights in any image or submission with full title guarantee; and

      2. waive all moral rights,

      3. in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

      4. You agree that the Promoter may, but is not required to, make your entry available on its website and/or Instagram page and on any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the draw entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

10. Data protection and publicity

    1. The Promoter will only process your personal information as set out in the PRIVACY POLICY. See also 6.3 and 6.4, with regard to the announcement of winners.

11. General

    1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

    2. The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

    3. These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
